Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and E-Rat, operated by DotJPGE Labs, regarding your use of our Electronic Notarization Facility platform ("Platform").

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

To use E-Rat's services, you must:

• Be at least 18 years of age
• Be a Philippine citizen or resident
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Not be prohibited by law from using notarization services

For Notaries: You must be a commissioned notary public in good standing under Philippine law and possess a valid Electronic Notarial Commission.

As a user of E-Rat, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Appear personally during video notarization sessions
• Present valid government-issued identification
• Complete biometric verification when required
• Use the Platform only for lawful purposes
• Not attempt to circumvent security measures
• Not share your account with others
• Comply with all applicable laws and regulations

Cancellation by User:

• Cancel up to 24 hours before scheduled session: Full refund
• Cancel within 24 hours: 50% refund
• No-show or cancellation after session start: No refund

Cancellation by E-Rat:

• If we cancel for any reason, you receive a full refund
• Technical issues beyond user's control: Full refund or rescheduling

You may not use E-Rat to:

• Commit fraud or misrepresent your identity
• Notarize forged or fraudulent documents
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware or harmful code
• Attempt to gain unauthorized access to our systems
• Use automated tools to access the Platform
• Reverse engineer or decompile our software

Violation of these terms may result in immediate account termination and legal action.

The Platform, including all content, features, and functionality, is owned by DotJPGE Labs and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of documents you upload. By using our services, you grant E-Rat a license to process, store, and display your documents solely for the purpose of providing notarization services.

E-Rat provides the Platform "as is" without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

• Loss of data or documents
• Service interruptions or technical issues
• Errors in notarization (responsibility of the notary)
• Unauthorized access by third parties

Our total liability shall not exceed the fees you paid for the specific service in question.

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms or your use of the Platform shall be resolved through arbitration in Manila, Philippines, in accordance with the rules of the Philippine Dispute Resolution Center, Inc.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
